All health carriers were required to submit a certification of compliance with state and federal health parity requirements with the Division of Insurance by October 1, 2013. Specifically, the Division’s regulations (211 CMR
154.03 (1) require Carriers to review their administrative practices to determine if they are in compliance with state and federal parity laws no later than October 1, 2013. Carriers were further directed to certify that their practices
were either in compliance with federal and state parity laws; and if they were not in compliance, the steps the Carrier has taken to bring the practices into compliance. We understand these reports were supposed to be a matter of public record, but we have been unable to review them.
The details of those reports have tremendous implications for consumer protection and access to behavioral health services. To date, the Division of Insurance has not released those reports. We the undersigned members of the Massachusetts Mental Health Coalition respectfully request any assistance your office can provide in obtaining the public availability of those reports.
