MPA Testifies to Support Anti-Clawback Legislation to Limit Retroactive Health Claims

 MPA testifies in support of H. 925, An act to limit retroactive health insurance claims for mental health and substance abuse services.

Michael A. Goldberg, Ph.D., Director of Professional Affairs for MPA testified on behalf of MPA in support of H. 925, An act to limit retroactive health insurance claims for mental health and substance abuse services.

At the hearing, Dr. Goldberg told legislators that because the policy of several for-profit  managed behavioral health plans in Massachusetts requires providers to submit claims for all services within 60 or 90 days and that they refuse to pay for claims submitted after that time period for any reason at all, some psychologists have terminated contracts with those providers and they now only accept private pay patients, which limits access to mental health services for consumers who don’t have the ability to pay out of pocket.

Dr. Goldberg testified that H. 925 would set a six month limit on how long insurers have to retract these funds paid to providers in cases other than fraud or other legitimate legal action, helping to improve access for consumers to mental health services.
