Proposal for Interstate Compact to Govern Telepsychology and Out-of-State Temporary Practice

The Association of State and Provincial Psychology Boards (ASPBB) has developed and is proposing an interstate regulatory compact for telepsychology and out-of-state temporary practice. According to ASPBB, the compact, called the Psychology Interjurisdictional Compact, or PSYPACT for short, "offers a reasonable yet responsible way for qualified licensed psychologists to offer services across state lines for temporary practice or practice using telecommunications technology".

The proposed compact establishes a common, shared legal and regulatory framework for participating states and establishes an Interjurisdictional Practice Commission to administer and oversee it by issuing “E-Passports” and “Interjurisdictional Practice Certificates” (for temporary out-of-state practice—notification of the out of state licensing board is still required) to psychologists who meet appropriate qualifications. If and when seven state licensing boards adopt this compact, the compact would then go into effect for the participating states.

APA is deciding whether it supports this major initiative by ASPBB, and they are inviting comments from APA members before June 25.

The MPA Advocacy Committee encourages MPA members to examine the compact proposal, a copy of which is attached, and to form an opinion about it. Our committee, together with Director of Professional Practice Michael Goldberg, is doing the groundwork with the aim of of providing input both to APA and also to the MPA Board to help the Board to decide whether to take a position on this proposal and lobby the Massachusetts Licensing Board for or against adopting it. We have solicited feedback from MPA counsel, Eric Harris, and also request your input as MPA members.

We will be discussing the compact proposal at our next Committee meeting, on June 8 at 7:00 PM at the MPA offices.
